She Sees Candy is designed with privacy in mind. The app performs its core functions entirely on your device. You do not need to create an account, and we do not track you or collect information about how you use the app.

This Privacy Policy explains what information She Sees Candy may receive, how we use it, and the choices available to you.

1. Who We Are

She Sees Candy is provided by Zurka Interactive LLC (“we,” “us,” or “our”).

For purposes of applicable data protection laws, including the European Union General Data Protection Regulation (“GDPR”), Zurka Interactive LLC is the data controller for information you voluntarily submit to us through She Sees Candy.

2. Information We Do Not Collect

When you use She Sees Candy normally, the app does not send us personal information or information about your use of the app.

In particular:

The app's candy identification and image-processing features operate on your device.

3. Optional Photo Sharing

She Sees Candy gives you the option to voluntarily share photos with us to help improve the app.

Photo sharing is optional and is turned off unless you choose to participate. You can use She Sees Candy whether or not you choose to share photos.

If you enable photo sharing, photographs you choose to share are transmitted to our servers. We use these photographs solely to evaluate and improve She Sees Candy, including improving the accuracy of its candy-identification technology.

We do not use submitted photographs for advertising, marketing, identifying users, recognizing people, or building profiles about users.

We do not publish submitted photographs or make them publicly available.

We do not sell submitted photographs or provide them to advertisers, data brokers, or other companies for their own purposes.

Service providers that host or operate infrastructure on our behalf may process submitted photographs solely as necessary to provide those services to us. They are not permitted to use the photographs for their own purposes.

4. Please Share Only Appropriate Photos

She Sees Candy is intended to identify candy. If you choose to share photographs with us, please share photographs of candy and avoid submitting photographs containing identifiable people, documents, addresses, financial information, or other personal or sensitive information.

We do not use photographs to identify individuals or for facial recognition or other biometric identification.

5. Technical Information Associated With an Upload

Sending information over the Internet necessarily involves the temporary processing of technical information required to establish a network connection, such as an Internet Protocol (IP) address.

We do not use this information to identify you, track you, create a profile about you, or associate your activity with activity on other services.

Our infrastructure may retain limited technical logs, including IP addresses, for reliability, fraud prevention, and troubleshooting purposes. We do not use those logs for advertising, tracking, or profiling.

6. How We Use Shared Photos

We use photographs voluntarily submitted through She Sees Candy only for purposes related to developing, testing, evaluating, maintaining, and improving the application and its image-recognition technology.

We do not use shared photographs to make decisions about you or to infer personal characteristics about you.

We do not use shared photographs for targeted advertising or marketing.

7. Legal Basis for Processing in the European Economic Area

If you are located in the European Economic Area (“EEA”), the United Kingdom, or another jurisdiction that requires a legal basis for processing personal data, our legal basis for receiving and using photographs you voluntarily share is your consent.

Photo sharing is optional. Refusing to share photographs does not limit the normal functionality of She Sees Candy.

You may withdraw your consent to future photo sharing at any time by disabling photo sharing within the app. Withdrawing consent does not affect processing that occurred before you withdrew your consent.

8. Retention and Deletion

We retain voluntarily submitted photographs only for as long as reasonably necessary to evaluate and improve She Sees Candy.

Submitted photographs may be retained for more than 12 months after submission. We may delete photographs sooner if they are no longer useful for application development or testing.

If a photograph has already contributed to improvements in a machine-learning model or other software, deleting the source photograph may not reverse improvements already incorporated into the software, provided those improvements do not identify you or contain personal information about you.

Because She Sees Candy does not require accounts and we intentionally do not associate submitted photographs with an identifiable user, we may not always be able to determine which photograph was submitted by a particular person. If we can reasonably identify a photograph as yours from information you provide, we will honor applicable deletion requests.

9. Sharing and Disclosure

We do not sell or rent personal information.

We do not share personal information with advertisers or data brokers, and we do not disclose information for targeted advertising.

We may disclose information when reasonably necessary to comply with applicable law, a valid legal process, or an enforceable governmental request, or when necessary to protect the security, rights, or safety of She Sees Candy, our users, or others.

We may also use service providers to perform infrastructure or hosting services on our behalf. Those providers may process information only as necessary to provide their services to us and are subject to appropriate confidentiality and data-protection obligations.

10. International Data Transfers

Zurka Interactive LLC is located in the United States.

If you are located outside the United States and choose to share a photograph, your photograph may be transmitted to and processed in the United States.

Where applicable law requires additional safeguards for international transfers of personal data, we use legally recognized safeguards appropriate to the service involved, which may include service providers covered by an applicable adequacy decision or contractual protections approved by the relevant authorities.

11. Your Privacy Rights

Depending on where you live, applicable privacy law may give you rights relating to personal information we hold about you. These may include the right to request access to, correction of, deletion of, or restriction of processing of your personal information, as well as the right to object to certain processing or obtain a portable copy of your information.

Where our processing is based on consent, you may withdraw that consent at any time.

Because we do not maintain user accounts, profiles, or identifying information associated with photo submissions, there may be circumstances in which we cannot identify information as belonging to you. We will not collect additional personal information solely for the purpose of identifying you unless necessary to respond to your request.

European Economic Area

If you are in the EEA, you also have the right to lodge a complaint with the data protection supervisory authority in your country of residence, place of work, or the location of an alleged violation.

12. California and Other U.S. State Privacy Rights

We do not sell personal information.

We do not share personal information for cross-context behavioral advertising, use personal information for targeted advertising, or profile users in connection with decisions that produce legal or similarly significant effects.

Accordingly, there is no sale, targeted-advertising activity, or similar processing for users to opt out of.

Residents of California and other U.S. states may nevertheless have additional rights under applicable state privacy laws. You may contact us at support@zurka.com with any request concerning those rights.

13. Children’s Privacy

She Sees Candy is intended for a general audience and is not directed specifically to children under the age of 13.

We do not knowingly collect personal information from children under 13. Children under 13 should not use the optional photo-sharing feature.

If we learn that we have collected personal information from a child under 13 in circumstances covered by the Children's Online Privacy Protection Act (“COPPA”), we will delete it as required by applicable law.

14. Data Security

We use reasonable administrative, technical, and organizational safeguards designed to protect photographs and other information submitted to us against unauthorized access, disclosure, alteration, or destruction.

No method of electronic transmission or storage can be guaranteed to be completely secure, however, and we cannot guarantee absolute security.

15. No Advertising or Monetization of Personal Information

She Sees Candy is currently offered without charge and does not contain in-app purchases or subscriptions.

We do not monetize the app by selling personal information, displaying targeted advertising, or allowing advertising companies to track users.

If our business model or information practices change in the future, we will update this Privacy Policy before applying materially different practices to information covered by this Policy and will obtain consent where required by law.

16. Changes to This Privacy Policy

We may update this Privacy Policy from time to time as She Sees Candy evolves or as legal requirements change.

When we make changes, we will update the effective date at the top of this Policy. If a change materially affects how we collect or use personal information, we will provide additional notice or obtain consent where required by applicable law.
